Terms & Conditions

These terms and conditions apply to all orders for delivery to the UK. Placing an order constitutes your acceptance thereof. Despatch of the products by us constitutes acceptance of the order by us and the commencement of our contract to supply. Your contract for supply is with Collie Flowers Ltd. Your statutory rights are not affected by any of these terms. 


Our Commitment 


Collie Flowers is committed to supplying high quality products to recreational gardeners and households for personal use and not for resale. In accordance with the established custom of the trade, Collie Flowers will in no case be liable for more than the actual amount paid for a particular item. 


Availability 


We will endeavour only to offer products which we expect to have in stock and available for ordering, but all items are subject to availability. Varieties that become unavailable will not be selectable on our website. Should a specific variety not be available at the time of dispatch, or if items are of unsuitable quality to send, we undertake to supply a variety of similar colour and habit, and of an equal or greater value or send the item when available. If no suitable substitutes are available, we will send a credit. Should you for any reason (including being unhappy with product substitutions) wish to receive a refund, you must return the product immediately. 


In the case of matching products to personalised orders, we commit to providing seed of the same Species requested, we do not stock of have access to all genus’ therefore will provide the best available genus of a species to complement the order as a whole. 


Delivery 


Orders including personalised products may take up to a week to process prior to shipping.  


Most seed orders are shipped within 2 working days of receipt of order. Orders received after 3pm are considered to have been placed the following day. 


Collie Flowers will only dispatch orders to addresses within the UK. 


All delivery charges are shown separately and added automatically to your shopping basket. 


The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 


In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order at any time up to 14 days after receipt. If you wish to cancel an order please contact our Customer Care department within 7 working days after receipt. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. We can arrange collection of larger items, but you will be charged for this service at cost. Please note: This excludes perishable items such as plants, bulbs, bareroots and tubers and we reserve the right to cancel any order. 

 

Payment and Vouchers 


We accept Visa and MasterCard credit/debit cards and payment by Paypal. Please note that your account will be debitedcashed on receipt of your order by us. If your card issuer or bank refuses to authorise payment to us, we will contact you for further instructions. We will not be liable for any resulting delay or non-delivery. Refunds are only payable to the purchaser of the goods. 


Online vouchers and promotional key codes are personal to each individual and any inappropriate use is fraud. We reserve the right to cancel any vouchers or promotional key codes at any time. Vouchers cannot be exchanged for cash and have no face value. 


Where an offer is made in error, and an incorrect discount applied, we reserve the right to cancel any order and terminate any such offers. 


Prices 


Prices reflect the latest prices for all products. However, we reserve the right to change prices at any time. All prices include VAT, if applicable. 

If, in error, a product(s) has been priced inaccurately, either at unit level or through the activation of a promotion, we will not be liable to supply that item(s) to you at the inaccurate price. In such circumstances, we will notify you of the correct price and ask you to confirm or decline your order for the item(s) in question. 


Endangered Species / Genetic Modification 


We will not knowingly offer for sale endangered species harvested from the wild or any genetically modified products. 


New and Exclusive 


Where an item is defined as 'New' it is new to our range. Where an item is defined as 'Exclusive' it means that this item is believed to only be available in this form from us and our associated brands.

All rights, including copyright, in the content of our catalogues and web pages are licensed to, owned or controlled by us. In accessing our web pages, you agree that you may only access the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium) transmit, show or play in public, adapt or change in any way the content of our web pages for any purpose without our prior written permission. 


Third Party Information 


We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for our products are those stated within our website. We will not be bound to prices quoted by shopping directories or other media.

We strive to provide the best possible products and level of service we can. Where we do not, we are here to assist you. We will respond promptly and efficiently to all comments to ensure you receive 100% satisfaction.

100% Customer Satisfaction or Your Money Back 


We promise to supply products in prime condition. If for any reason you are not 100% delighted upon receipt of your order, please advise us by email or in writing within 7 days and we will offer a replacement (subject to availability), or credit, or refund the purchase price. Please note that any manufactured goods (e.g. gardening sundries) must be returned if you require a refund. It would be helpful if photographic evidence is provided when requesting a refund or replacement. 


Please advise us promptly as this allows a replacement to be sent (subject to availability) and to ensure you still have time to achieve total satisfaction from your purchases. 


In the unlikely event that you are not satisfied with your seed germination, please notify us within 30 days of the prescribed germination time (specified on the seed packet, catalogue or online product page) enclosing both the outer packet and sachet. 

We cannot accept responsibility for items that fail to grow due to extreme weather conditions, over or under-watering, or which have not been cared for according to the easy-to-follow instructions supplied.
